"The U.S. government has decided to award Boeing contracts for the construction of two sections of a high-tech fence to be built along the border with Mexico in Arizona, Department of Homeland Security Secretary Michael Chertoff said on Monday.

The two fence sections would be an "operational configuration" of a much-criticized 28-mile (45-km) section of "virtual fence" built by Boeing and tested earlier, Chertoff told a news conference.

He said the fence would include fixed towers, with radar sensors, remote control cameras, ground sensors and software linking border agents to give them a "common operating picture" of the areas they are enforcing."

The lawsuit by the Frontera Audubon Society, the Friends of the Santa Ana National Wildlife Refuge and the Friends of the Laguna Atascosa National Wildlife Refuge claims that Homeland Security Secretary Michael Chertoff violated the Constitution's separation of powers when he waived 36 federal environmental laws to speed up construction of the fence."

City officials in El Paso and Presidio this week joined with the Texas Border Coalition (TBC) in a lawsuit charging that Homeland Security officials, including Mr. Chertoff, "blatantly ignored federal law in their zeal" to complete construction of the fence by year's end and failed to consult with property owners as promised."

In an effort not seen since the panic unleashed by the Great Depression, federal law enforcement has been targeting technically illegal workers who have been long tolerated in industries like meat packing, poultry processing and agriculture. In the terror created, fruit trees are being cut down and fields lie fallow, for want of traditional workers.

Many hundreds of otherwise law abiding, hard working, family men and women have been arrested in recent weeks under circumstances more appropriate to operations targeting al Qaeda. With noise and fury, these heavily armed and armored SWAT teams from ICE, Immigration and Customs Enforcement, are surrounding a particular plant, then with great quasi-military flourish sweeping in to arrest and handcuff the 'aliens', bring them en masse to a hearing, conviction and sentencing, all pending deportation. Speaking at a hurricane preparedness gathering Tuesday at FEMA headquarters in Washington, Chertoff said he wanted to "drive a stake through the heart of a misapprehension which is out there."

"In the event of an emergency, and the need for an evacuation, priority No. 1 by a country mile is the safe evacuation of people who are leaving the danger zone," Chertoff said. "Instructions to the Border Patrol and Customs and Border Protection are clear. They are to do nothing to impede a safe and speedy evacuation of a danger zone.""

"The all-Democratic Congressional Hispanic Caucus, which includes 17 Latino members of Congress, has dug in its heels in an effort to bring relief to undocumented workers and their families who are currently being subjected to immigration raids. But in return, it is becoming the target of heavy pressure from the hotel, resort, seafood and other industries.

Last fall, the leadership of the Caucus developed a strategy to create leverage for progress on immigration reform. Concluding that the full package of “comprehensive immigration reform” was not achievable until the Democrats increased their congressional majority and replaced Bush in the White House, the Caucus decided to narrow its focus to measures that would undo the harm being done everyday by the immigration raids and other enforcement procedures ordered by Homeland Security Secretary Michael Chertoff. So the Caucus tentatively adopted a proposal from grassroots immigrants’ rights activists to provide provisional, renewable five-year visas for most undocumented immigrants now living and working in the United States."

"When it comes to electing our next President and all public officials but it's not proving true in changing the mind of the Secretary of the Department of Homeland Security, Michael Chertoff, who is waiving 30 laws and regulations to bulldoze his will to get the fence/wall built.

And that's why Sec. Chertoff's actions are very dangerous if left unchallenged.

LULAC and the Sierra Club Condemn Bush Administration’s Border Wall Waiver

"The League of United Latin American Citizens’ (LULAC) and the Sierra Club’s combined membership and supporters of more than 1.3 million have joined forces to denounce Tuesday’s decision by the Secretary of the Department of Homeland Security to issue a waiver of dozens of laws to expedite construction of a controversial 620 mile wall along the U.S. Mexico border.

“LULAC firmly believes that the waivers are unconstitutional and should be looked at by the U.S. Supreme Court,” said LULAC National President Rosa Rosales. “We agree with the Sierra Club that the destruction of the borderlands ecosystem is a serious matter and that the Department of Homeland Security should comply with environmental, cultural and local laws which are being compromised in the overzealous pursuit of border enforcement.”

Secretary Chertoff chose to bypass stakeholders and push through this unpopular project instead of continuing to consult with local communities or follow longstanding laws, a process which the department has already started.

The Department of Homeland Security has faced intense opposition from border communities and has had to go to court against more than 50 property owners simply to survey land for the fence.

In March, the Sierra Club and Defenders of Wildlife asked the U.S. Supreme Court to hear the challenge that such waivers are unconstitutional.
