After failing out and losing his need-based scholarship, Garcia transferred to East Chicago — where he was granted partial eligibility by IHSAA commissioner Blake Ress in November 2006.
That decision was appealed by Garcia via his attorneys at an IHSAA review committee meeting in December, but that panel upheld Ress decision.
A temporary restraining order was sought last week and granted by Judge Robert A. Pete. Now, Garcia is seeking to get a preliminary injunction against the IHSAA so he can play the rest of the regular season.”
