Hispanic day laborers drop free-speech claims rather than reveal status in U.S. harassment case – New York

The plaintiffs’ lead lawyer, Alan Levine, said that if any of the plaintiffs testified to being an illegal immigrant, “It would likely put them at considerable jeopardy. … They could be deported.”

“Several day laborers who have accused a suburban village of harassing them as they look for work dropped all claims of free-speech violations Monday rather than reveal their immigration status.

The decision, just before the start of a federal trial in White Plains, meant the six plaintiffs, all listed as JohnDoe in the court papers, would no longer argue that the Village of Mamaroneck was attacking their First Amendment rights to free speech and free association.”
